  1. The starting price: 5,440 CAD (five thousand four hundred forty Canadian dollars).

The passenger vehicle being sold can be viewed at the Consulate General of the Republic of Poland in Toronto, 2603 Lake Shore Blvd. West, ON M8V 1G5 on business days from January 17, 2022 to January 31, 2022. from 10:00 a.m. to 2:00 p.m. Beforehand, it is necessary to make an appointment. Please send an email to the following address: toronto.info@msz.gov.pl).The location has a high security standard, therefore, it is impossible to see the vehicle without an appointment. The visitors must comply with the applicable sanitary regulations.

 

  1. Participation in the tender is conditional upon the bid bond of 10% of the starting price, i.e. 544 CAD. The bid bond must be paid in cash at the cash desk of the Consulate General of the Republic of Poland in Toronto by January 31, 2022. by 2:00 p.m. local time.

 

  1. The bid should be made in writing according to the attached template – Attachment 1 and should contain:

 

  1. First name and last name or business name, detailed address and telephone number of the Bidder.
  2. The offered price (expressed in numbers and words) and the method of payment.
  3. The Bidder's declaration that he/she is familiar with the condition of the vehicle or that he/she is aware of the consequences of resignation from the vehicle inspection.
  4. Declaration of the Bidder that he/she is familiar with the processing of personal data (GDPR) in the form specified in Attachment 2 to this advertisement.

 

  1. Written bids (according to the attached template – Attachment 1) should be submitted to the Consulate General of the Republic of Poland in Toronto or sent to the Consulate’s address 2603 Lake Shore Blvd. West, Toronto ON M8V 1G5 (in closed envelopes) with the note "Tender for a BMW 528 XI vehicle - do not open", by January 31, 2021 2:00 p.m. local time.

 

  1. The bids will be opened by the Tender Committee at the meeting on February 1, 2021. at. 2:00 p.m. at the Consulate General of the Republic of Poland in Toronto, 2603 Lake Shore Blvd. West, ON M8V 1G5, Toronto.

 

  1. The Committee will select the Bidder offering the highest price.

 

  1. The bid bond paid by the Bidders whose bids have not been selected or have been rejected will be returned within 7 days from the date of selection or rejection of the bid. The bid bond submitted by the buyer will be included in the purchase price.

 

  1. The bid bond is not refundable if the Bidder who wins the tender fails to conclude the Purchase and Sale Agreement.

 

  1. The bid is subject to rejection if it is submitted after the deadline, in the wrong place or by a Bidder who has not submitted the bid bond, or if it does not contain the data and documents indicated in the advertisement or if it is incomplete, illegible or raise doubts, and the submitted explanations could indicate that the bid is new. A natural person participating in the tender is required to have: an identity card, proof of payment of the bid bond and a signed declaration of being aware of the legal and factual status of the vehicle, and an individual representing a legal person is also required to have appropriate powers of attorney and a current excerpt from the Canada’s Business Registries.

 

  1. The Purchase and Sale Agreement will be concluded within 7 days from the selection of the bid, i.e. on February 8, 2021.

 

  1. The buyer is obliged to pay the purchase price and pick up the vehicle, at the latest, on the day when the Agreement is concluded.

 

  1. The seller is obliged to hand over the vehicle immediately after signing the Purchase and Sale Agreement and payment by the buyer, and the buyer is obliged to collect the vehicle. The vehicle will be released without license plates and insurance.

 

  1. All costs, taxes and fees related to customs duties and the purchase of the vehicle are borne by the buyer. By entering the tender, the buyer agrees and is obliged to pay all taxes and fees required by the authorities of Canada, Poland or any other country to which the vehicle will be delivered after being sold.

 

  1. The Consulate General of the Republic of Poland in Toronto reserves the right to close the tender at any time, inconclusively, and without justifying its decision.

 

  1. The Consulate General of the Republic of Poland in Toronto is not responsible for hidden defects of the vehicle. The sale is carried out in accordance with the clause: "the vehicle in the condition as is in the garage" without any guarantee from the seller or the Polish State.

 

The tender is carried out in accordance with the REGULATION OF THE COUNCIL OF MINISTERS of October 21, 2019 (Journal of Laws of 2019, item 2004).
