VIEWING VEHICLE - VENUE AND TIME:

Please note that Bidders are invited to inspect the vehicle from Monday to Wednesday, February 22-24 and March 1-3, 2021, between 10.00 am to 12.00 noon (by prior appointment via Tel. No. +254 20 7120019/20) at the following venue: Embassy of Poland, 58 Red Hill Road (off Limuru Road), Nairobi.

CONDITIONS FOR TENDER:

1. The condition of the tender is to pay a deposit in cash of 10% as a bid bond, an amount of EUR 1,400 (EUR one thousand four hundred) at the Cash Desk of the Polish Embassy in Nairobi. Confirmation of payment of the bid deposit will be a copy of cash received document attached to the offer.
2. The bid bond submitted by bidder whose offers have not succeeded, or that have been rejected, will be returned within 7 days from the date of selection or rejection of the tender.
3. The bid bond deposit submitted by the buyer is included in the price.
4. The tender deposit is not refundable if the successful bidder, who won the public tender, fails to conclude the sale agreement.

 

TENDER DOCUMENTS:

The offers should include the following information:

• Details in accordance to the attached template – ANNEX 1;
• The offered price should not be lower than the asking price;
• The bidder's declaration that he/she is conversant with the legal and factual state of the vehicle, or is willing to incur all and any liability for the consequences arising from the failure to inspect the vehicle.  
• Declaration regarding the processing of personal data (GDPR) on the form set out in Annex 2 attached to this announcement (applies only to EU citizens);
• cash received document confirming the deposit payment;

In the event of a legal entity participating in the tender, a valid excerpt from the relevant register must be attached to the tender.

DATE PLACE AND MODE OF SUBMITTING TENDER:

The offer, along with the required documents, should be submitted in a sealed envelope at the following address: Embassy of Poland in Nairobi, 58 Red Hill Road (off Limuru Road), Nairobi, Kenya.

The envelope should bear the inscription "Offer in the tender for the sale of the Toyota Land Cruiser VX". Written offers should be submitted at the Embassy from Monday to Wednesday between 10.00 am to 12.00 pm, BUT not later than 12 noon on the15/03/2021. The offer is binding for 14 days.

The Organizer of this Public Tender, has the right to close this tender without selecting any of the offers, and without giving any reason.

REJECTED OFFERS:

The tender committee will reject the offer if:

• it was submitted after the prescribed deadline, or in the wrong place or by the tenderer who did not provide the bid bond deposit;
•  it does not contain the data and documents referred to in this announcement or these are incomplete, illegible or otherwise doubtful, and its supplementation or the provision of explanations could lead to its being considered a new offer.

The tender committee shall immediately notify the tenderer of the rejection of the tender.

OTHER INFORMATION:

The successful Buyer is obliged to pay the purchase price within 7 days from the date of signing the Sale Agreement.

The object of the sale will be handed immediately after the Buyer pays the purchase price within the time limit specified by the Seller.

If the buyer does not pay the stipulated amount offered to the Seller's cash desk within the set deadline, he/she loses the right to purchase the car that is the subject of the tender, and the tender committee will propose to sell the vehicle to the next highest bidder in the Tender.

All costs, taxes and fees related to the purchase of the subject of the tender are borne by the buyer. By entering the tender, the buyer agrees and undertakes to pay any taxes and fees required by the authorities of Kenya or other country to which the vehicle will be delivered after sale

DATE & VENUE – OFFICIALLY CONDUCTING THE PUBLIC TENDER:

The Tender Committee will open the bids at the Registered Office of the Seller on March 17, 2021 at 10:00 am local time.
