Acquiring employment agency certificate

Requirements for operating an employment agency:

In order to operate in Poland, employment agencies must be entered into the Register of Employment Agencies. 

 

Procedures for the Register of Employment Agencies:

Agencies are entered into the register by the Province Marshal having jurisdiction over their registered offices. In practice, the entire procedure takes place at Provincial Labour Offices (organisational units reporting to the Marshal).

Applications for entry into the register may be submitted in paper form or in electronic form – by completing a form available at http://stor.praca.gov.pl/portal/#/kraz/skladanieWnioskow.

An application must include: the identification of the entity applying for entry into the register, the address of residence or the address of the registered office and addresses where the business activities will be carried out, together with the name of the municipality and province and the telephone number, the identification of the legal form of the business activities, the type of services provided (job placement, recruitment consultancy, career counselling or temporary employment), the Taxpayer Identification Number NIP, the number of the entry into the register of entrepreneurs of the National Court Register or information on the entry into the Business Activity Central Register and Information Record (for an undertaking), and the email address, if the entity has one. 

The Province Marshal issues a certificate of entry into the register, authorising the entity to provide the services selected.

The issue of the certificate is subject to a fee of PLN 200.

Employment agencies cannot charge fees from persons for whom they seeks employment or other paid work or whom they assist in selecting the appropriate occupation and place of employment, except for amounts due to employment agencies for the costs actually incurred in connection with referral to work abroad for travel abroad and back by the referred person, medical examinations, the translation of documents and the issue of a visa.

If the data entered into the register change, employment agencies are required to submit an application to update them. The same applies to applications for removal from the register. The application may be submitted in paper or electronic form.

A potential refusal, removal or ban on operation is issued by means of an administrative decision. Legal remedies against the above decision are specified in these documents.
