What you need to prepare
One of the following documents:

an accident report – if you are unable to work due to an accident at work. Such a report will be prepared by the contribution payer – the employer,
-
a medical certificate confirming that your incapacity for work was caused by an accident at work – if you became unable to work at a later date, but as a result of a previously verified accident at work,
-
a decision on an occupational disease diagnosis issued by a sanitary inspector and a certificate from the doctor who issued a sick note declaring you unable to work as a result of an occupational disease – if you have an occupational disease.
A contribution payer – is any company, institution or person that registers insured persons with the Social Insurance Institution and settles and pays social or health insurance contributions for them. It may be, for example, an employer or a person running a business.
The sick note will be sent to the Social Insurance Institution (ZUS) and the contribution payer in electronic form (e-ZLA). If, however, your employer does not have a profile on the PUE ZUS portal – about which you should be informed in writing on the first day of work – then that person will not be aware that a doctor has issued an e-ZLA sick note. In such a situation, submit a printout of the sick note that you will receive from the doctor.
If the benefit is paid by the ZUS, an application for the benefit will be necessary. During your employment, your contribution payer (the employer) submits the application on your behalf – this application is the Z-3 contribution payer’s certificate.

When to submit the documents
Straight away – if you have all the required documents.
If you wish to obtain a benefit for sick leave that has already ended, submit the documents within 6 months from the last day of sick leave. If you cannot submit the documents within this deadline for some reason (for example, you are in hospital), you may submit them within 6 months from the date on which this reason ceases to apply.

to the payer or to a ZUS branch, if your payer employs up to 20 workers. Preferably, take the documents to the ZUS branch having jurisdiction over the contribution payer’s registered office. If you take them to another ZUS branch, the staff will send your documents to the relevant branch.

How much you may receive
100% of the benefit assessment basis.
The benefit assessment basis is your average monthly remuneration from the last 12 months before the day when you became unable to work. The portion of social insurance contributions that you pay must be deducted from this amount. If your insurance covers a period shorter than 12 months – then the entire period of insurance is taken into account.
The ZUS or the contribution payer will calculate the exact amount of your benefit.

If you do not agree with the ZUS’s decision
Write an appeal to the district labour and social security court, but take it or send it to the ZUS branch that issued the decision. You should do this within one month from the receipt of the ZUS’s decision.

If you run a business or work together with a person running a business, then you will receive a sickness benefit if social insurance contributions were paid in a timely manner (the person running a business pays contributions for the co-worker).
If the Social Insurance Institution (ZUS) finds that you did not pay contributions and your debt is higher than PLN 6.60 (the debt is established as at the date of the accident or submission of the application for a benefit for an occupational disease), then you are not entitled to the benefit until you repay the debt in full.
If you repay the debt in full within 6 months from the date of the accident or the date of submission of the application for a benefit for an occupational disease, then you will be entitled to the benefit for the entire period of incapacity for work.
If you repay the debt in full after 6 months, you will be entitled to the benefit only from the date of repayment of the debt.
