Notification of cross-border activities
Foreign undertakings from:
-
Member States of the European Union,
-
European Economic Area (the EEA) countries,
-
and countries which are not members of the EU or parties to the EEA Agreement, which may provide services under agreements concluded with the European Union, may provide job placement, recruitment consultancy or career counselling services in Poland, without being entered into the Register of Employment Agencies. In order to do this, the agencies must operate legally in their countries.
Before they begin to provide job placement, recruitment consultancy or career counselling services in Poland, foreign undertakings are required to notify the Province Marshal having jurisdiction over the place where the services are to be provided. In practice, the entire procedure takes place at Provincial Labour Offices (organisational units reporting to the Marshal).
The following data must be included in a notification:

the name of the undertaking’s country of origin

the identification of the undertaking and the address of the registered office

where, when and what type of services are to be provided in Poland.
Documents authorising the undertaking concerned to provide job placement, recruitment consultancy or career counselling services in the country of origin, translated into Polish by a sworn translator, should be submitted together with the notification.

Please note!
The above procedure does not apply to Temporary Employment Agency activities. In this case, foreign undertakings must be entered into the Register of Employment Agencies.
