Housing projects of the Polish Deal adopted by the Council of Ministers

A flat without own contribution and facilitations in the construction of residential houses of up to 70 m2 are the two flagship projects of the Polish Deal, which were adopted today by the Council of Ministers. The new solutions will improve the housing situation of Polish families. This will be helped by state support in obtaining and repaying housing loans and simplifying the construction procedure for small residential houses up to 70 m2.

This is what the housing projects we have taken over today in the Polish Deal serve. On the one hand, it is a family-friendly, pro-demographic solution in the form of guaranteed own contributions. The second solution, which is a breakthrough in the history of Polish construction, is the simplified construction of houses of up to 70 m2. It will unleash the energy of Poles and allow them to fulfil their dreams of owning their own home more easily and safely,”

Housing without contribution - the most important solutions

Easier access to housing and a secure housing situation is the livelihood basis for families. Therefore, increasing access to homeownership by strengthening creditworthiness is indispensable for our socio-economic development.

Bank Gospodarstwa Krajowego (BGK) will guarantee up to 20% of the loan amount, not more than PLN 100,000, for a maximum of 15 years. After the birth of the second or subsequent child in the family, BGK will repay part of this credit.

  • A loan without own contribution will be a housing mortgage loan meeting the conditions set out in the Act and granted by banks joining the programme on the basis of an agreement concluded with BGK.
  • The state, through BGK, will guarantee up to 20% of the loan amount, but no more than PLN 100,000.
  • BGK will make a one-off repayment of part of the guaranteed housing loan in connection with the birth of a child. This will be the so-called family repayment, which will amount to:
    • PLN 20,000 - in the case of enlarging the household with a second child,
    • PLN 60,000 - in the case of enlarging a household with a third or subsequent child.
  • The loan is granted for a minimum of 15 years.
  • The guaranteed housing loan may be granted in the Polish currency. As a result, there will be no exchange rate risk.
  • The draft also contains mechanisms to limit the risk of stimulating housing price increases:
    • This will be the introduction of a maximum price limit (including construction contribution) per 1 m2 of usable area of the financed flat.
    • The second of the possible mechanisms to be applied will be the authorisation for the Council of Ministers to reduce, by regulation, the amount of the coefficients affecting the statutory price limits.

The new regulations will enter into force six months after their announcement in the D Journal of Laws.

Improvements in construction of houses with the built-up area of up to 70 m2 - the most important solutions

A house without formalities is a solution that meets the need to have one's own home, which is well-established in Polish culture. Thanks to the change in regulations, citizens will have a choice. Everyone will be able to start the construction of a small single-family house, assuming responsibility for managing the construction without obtaining a building permit, without the obligation to appoint a site manager and keep a construction log.  

  • Such buildings are to be free-standing and no more than two storeys high, and their area of influence must be entirely within the plot on which they are designed, and the construction is carried out in order to satisfy the investor's own housing needs. These buildings are intended to be small and of simple construction to facilitate compliance with safety requirements.
  • The permissible built-up area of these houses has been specified to 70 m2. The number of designed buildings may not exceed one for each 500 m2 of plot area. This condition will guarantee that the designed construction will serve only individual purposes and not the construction of multi-building estates.
  • Simplification is introduced in the procedure for notification of construction of houses up to 70 m2, consisting in exclusion of the possibility for the architectural-construction administrative body to object to the investor's notification of such construction - construction will be able to proceed immediately after delivery of such notification to the architectural-construction administrative body.
  • The investor will be obliged to attach to the notification a declaration stating that:
    • the planned construction is carried out in order to satisfy his own housing needs,
    • he accepts responsibility for managing the construction site in the event a construction manager is not appointed,
    • the documentation attached to the notification is complete.
  • We care about safety. Therefore, the construction of a house will require notification to the construction supervision authorities of the intended date of commencement of construction works.
  • The possibility to build recreational houses under the notification procedure is also extended from the current maximum area of 35 m2 to 70 m2, with the following restrictions introduced: the span of structural elements of such buildings may not exceed 6 m and the overhang of supports may not exceed 2 m.
  •  In the absence of a local zoning plan, a zoning decision for houses up to 70 m2 will be issued within 21 days.

The new regulations will come into force after 2 months from the date of their announcement in the Journal of Laws.
