The President signed the Act on houses up to 70 sq m.

The act, prepared in the Ministry of Economic Development and Technology, concerning construction of single-family houses for own residential purposes with the footprint of up to 70 square metres, has been signed by the President of the Republic of Poland. Thanks to these regulations, the construction of single-family houses with a built-up area of up to 70 square metres will be much easier. This is one of ten key regulations included in the government's Polish Deal programme.

It is a simplified procedure for Polish families to build their own house. For the same money for which one could buy a studio apartment in a big city, they will be able to build their own house in a simple procedure.

Houses up to 70 m2 - the most important assumptions

The permissible area for houses is 70 sqm. The building is to be free-standing and no more than two-storey. A maximum of two storeys may contain even more than 100 m2 of usable area.

No need to employ a construction manager and keep a construction log.

Land development conditions will be issued in 21 days maximum.

Construction must be carried out in order to satisfy the investor's own housing needs.

In accordance with the assumptions of the Act, residential buildings are to be small, with a simple structure, which is to facilitate compliance with safety requirements. The impact area must fit entirely within the plot or plots on which they are designed.

In addition, the possibility to build recreational houses under the notification procedure has been extended - in addition to the current maximum parameter of 35 m2 of built-up area, also with a built-up area of up to 70 m2. However, the span of structural elements of recreational houses up to 70 sq m may not exceed 6 metres, and the reach of supports may not exceed 2 m,

A simplification has been introduced in the procedure for notification of construction of houses up to 70 m2, consisting in exclusion of the possibility for the architectural and construction administration body to object to the investor's notification of such construction. This means that the construction may be commenced immediately after the delivery of such a notification to the architectural-construction administrative body.

The investor will be obliged to submit statements to the effect that:

  • the planned construction is carried out in order to satisfy his own housing needs
  • the accepts responsibility for managing the construction site if a construction manager is not appointed,
  • the documentation attached to the notification is complete.

Construction of a house will require notification of the intended date of commencement of construction works to the construction supervision authorities. This is to guarantee the safety of the investment.

In the absence of a local zoning plan, a zoning decision for houses up to 70 m2 will be issued within 21 days. The act will not cause spatial chaos, the new act does not change the existing regulations regarding the zoning plan.
