Active Parent

On 12 June 2024, the Act on supporting parents in active work and childrearing was published in the Journal of Laws of the Republic of Poland and thus became part of Poland’s legal framework. The Act will introduce 3 new benefits for parents raising young children. The Social Insurance Institution will accept applications for the new benefits starting from 1 October 2024. The scheme constitutes the implementation of the announcement made by the Prime Minister Donald Tusk in his exposé.
The Act introduces three “active parent” benefits into the legal system, supporting parents in their professional activity and in raising their children:
- “Active parents at work” benefit
- “Actively in the nursery” benefit
- “Actively at home” benefit
Every young child in Poland deserves good care, every parent of a young child in Poland deserves support in providing such care for their toddler. Be it care provided by a grandmother, aunt, uncle or grandparent, professional care provided by a nanny, in a nursery or parental care. The Active Parent scheme is intended to facilitate childcare. It is also a scheme to activate parents in the labour market. This scheme will help mothers to return to work after giving birth and fathers to return to work after a period of leave devoted to childcare, said Minister Agnieszka Dziemianowicz-Bąk.
“Active parents at work” benefit
It is intended for working parents of children aged 12 to 35 months. The Act defines the professional activity, the level/type of which will entitle to the aforementioned benefit. The “Active parents at work” benefit amounts to PLN 1,500 per month and will be paid from the 12th to the 35th month of the child’s life. In the case of children with a disability certificate including indications of: the need for permanent or long-term care or assistance from another person in connection with significantly limited ability to live independently, and the need for permanent participation of the child's guardian in the child's everyday life in the process of treatment, rehabilitation and education, the above entitlement will be increased to PLN 1,900 per month.
“Actively in the nursery” benefit
It will replace the current subsidy for the cost of a child’s stay in a nursery, children’s club, or with a day caregiver, which amounts to a maximum of PLN 400 per month. The existing subsidy is covered by the Act of 4 February 2011 on care for children under the age of 3. The “Actively in the nursery” benefit will be provided to the parents of children attending care institutions for children up to the age of 3. - i.e. a nursery, children's club or a day caregiver, and will amount up to PLN 1,500 monthly per child or up to PLN 1,900 monthly per a disabled child, but no more than the fee borne by the parent for the child's stay in the care institution.
The Act also introduces an upper limit for nursery fees which, if exceeded, will exclude the care institution or day caregiver concerned from the “Actively in a nursery” scheme, in order to avoid a situation where the introduction of the above benefit would result in a significant increase in fees for a nursery, children's club or a day caregiver. In the first period of the Act implementation, the above threshold will be a flat rate and will amount to PLN 2,200 per month.
With the introduction of the “Actively in the nursery” benefit, the current provisions of the Act on the care of children up to the age of 3 concerning subsidy for the cost of a child’s stay in a nursery, children’s club, or with a day caregiver will be repealed. The parent will be able to retain the right to the above-mentioned subsidy as the acquired rights are protected. However, they will be able to switch to new benefits, in particular the far more favourable “Actively in the nursery” benefit.
“Actively at home” benefit
It will replace the existing and less favourable, as it does not apply to the first child, Family Care Capital. “Actively at home” benefit will be paid for each child in the family from the 12th to the 35th month of the child’s life in the amount of PLN 500 per month for 24 months (one will not be able to receive the benefit of PLN 1,000 for 12 months, as is the case with the Family Care Capital). This support is aimed at those parents of children aged between 12 and 35 months who will not be eligible or who, of their own free will, choose not to take participate in “Actively at work” or “Actively in the nursery” benefits, as they remain economically inactive or their child is not attending a care institution.
The introduction of the “Actively at home” benefit will lead to the repeal of the existing Act of 17 November 2021 on family care capital, while preserving acquired rights, i.e. the parents will retain the right to the previously granted Family Care Capital with the possibility to switch to the new benefit if it is more favourable to them (e.g. professionally active parents receiving Family Care Capital will be able to drop this benefit and apply for the “Active parents at work” benefit).
- The parents will decide which of the three benefits to choose. However, only one of the benefits may be paid for the same child in any given month.
- The parent will also be able to change benefits multiple times, i.e. to switch from one form of support to another, provided that they will only receive one benefit for the same child for a given month.
In addition, the Act introduces amendments to the Act of 4 February 2011 on childcare for children up to the age of 3, aimed at improving the availability and quality of the services provided by these institutions. In addition, it also introduces regulations enabling the minister with responsibility for family affairs to announce and implement schemes covering additional measures to improve the quality of care in institutions for children up to the age of 3, to promote and make parents aware of the importance of proper institutional care from the perspective of a toddler's development, and to carry out research or evaluation of the solutions introduced in order to improve and refine them. Thus, the Act is also in line with the assumptions and strategic goals of the National Recovery and Resilience Plan by fulfilling milestones that cover reforms to improve the status of parents in the labour market and facilitate access to high-quality childcare for children up to the age of 3.
The “Active Parent” benefits will be paid from 1 October 2024 by the Social Insurance Institution. The first funds under the scheme will be paid no later than two months from the date of application with adjustment.
