Tasks of the department:
The Department of Funds is responsible for the management of the Labour Fund resources, considering the needs of the regional and local labour markets and the needs related to employment restructuring within the framework of government programmes, as well as for the management of the Guaranteed Employee Benefits Fund (FGŚP) resources and the design of principles for the protection of employee claims and the performance of tasks related to the supervision of the Fund administrator over the management of the movable property of the FGŚP in use by the Voivodship Labour Offices, with the exclusion of matters concerning its records.
The tasks of the Funds Department, with regard to the Labour Fund, include:
- developing assumptions for the financial plan of the Labour Fund, the draft financial plan of the Labour Fund, as well as preparing proposals for changes in the plan during the year, performing tasks related to conducting statistical research of public statistics in the scope of monitoring revenues and expenditures of the Labour Fund together with their analysis, including the analysis of effectiveness of basic forms of professional activation;
- managing Labour Fund resources, including setting expenditure limits for starostas, voivodes, voivodship marshals and Voluntary Labour Corps (Polish Ochotnicze Hufce Pracy, OHP) within the amounts included in the Labour Fund financial plan;
- conducting matters related to providing pre-financing from the Labour Fund for projects of district labour offices co-financed from the European Social Fund Plus (ESF+);
- conducting matters related to the conclusion and implementation of agreements and arrangements for the transfer of Labour Fund resources to bodies and institutions authorised to finance from the Labour Fund tasks specified by law;
- designing the principles of co-financing the salaries of local government administration employees working in labour offices and performing tasks financed from the Labour Fund and related to the service of the Labour Fund;
- preparing assumptions for the financial plan of the FGŚP and the draft financial plan of the Guaranteed Employee Benefits Fund (FGŚP), as well as reports on its implementation, preparing proposals for changes in the plan during the year, as well as monitoring revenues and expenditures of the FGŚP and analysing them;
- setting limits for FGŚP expenditures for voivodship marshals and conducting matters related to accounting for the use of FGŚP funds transferred to voivodship marshals or directors of voivodship labour offices for the payment of benefits and monitoring the realisation of FGŚP revenues and expenditures in voivodship labour offices;
- performing tasks related to the management of the assets of the FGŚP, excluding the management of the FGŚP's real estate and conducting matters related to the FGŚP's property records;
- handling cases and evaluating applications of voivodship marshals for granting funds for expenditure and investment purchases from the FGŚP funds;
- assessing applications of voivodship marshals, directors of voivodship employment offices or FGŚP debtors for determination of conditions for reimbursement of FGŚP receivables, rescission of reimbursement or write-off of FGŚP receivables;
- supervising the implementation of agreements with the Bank Gospodarstwa Krajowego concerning the 'First Business' and 'Government Programme First Business – Support at Start' programmes, as well as monitoring the financial and material effects of their implementation, and conducting matters concerning the cancellation, deferral of repayment dates and spreading into instalments of the Labour Fund's financial receivables in the scope of loans granted from the Bank Gospodarstwa Krajowego;
- notifying relevant guarantee institutions of the EU Member States of payments made by voivodship marshals in the event of employers' insolvency occurring outside Poland, and cooperating with guarantee institutions of the EU Member States or the European Free Trade Association (EFTA) Member States in the area of protection of employees' claims;
- providing interpretative clarifications, developing recommendations and guidelines in the scope of financial management of the Labour Fund or the FGŚP and application of regulations on financing from the Labour Fund resources the creation, equipping or retrofitting of workplaces, as well as starting economic activity, establishing or joining social cooperatives, including the costs of legal assistance, consultations and advice;
- issuing opinions and drafting assumptions of draft laws and acts concerning:
a) promotion of employment, with regard to the management of the Labour Fund resources,
b) protection of employee claims in the event of employer insolvency,
c) other laws in the scope of management of the Labour Fung or FGŚP resources, as well as development of draft executive acts concerning:
- financial management of the Labour Fund or the FGŚP,
- financing from the Labour Fund resources the creation, equipping or retrofitting of workplaces, as well as starting economic activity, establishing or joining social cooperatives, including the costs of legal assistance, consultations and advice; - supervising the implementation of agreements concluded with organisations running Entrepreneurship Development Funds (PRF), conducting matters related to the management of PRF property within the implementation of the project ‘Development of Small Business TOR#10’, as well as cancelling in whole or in part, deferring payment deadlines and spreading into instalments the repayment of monetary receivables on account of loans for the commencement of business activity or its running granted from PRF funds.
