Tasks of the department
The Labour Law Department is responsible for defining the course of action and carrying out tasks in the field of individual labour law, occupational health and safety (OHS) and remuneration of employees of certain units of the state or local government budgetary sphere. This primarily includes the preparation and implementation of appropriate solutions in the legal order, including those arising from international law.
The tasks of the Department include:
- preparing governmental draft amendments to the Labour Code and other acts as well as draft normative acts in the field of individual labour law, including in the field of health and safety at work and salaries for employees of certain units of the state or local government budgetary sphere, aiming at full alignment of the Polish law with the EU law and the acts of the ILO, the Council of Europe, as well as taking into account the needs of practice;
- preparing and drafting a bill on the protection of whistleblowers aimed at implementing the Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law into the Polish legal order;
- preparing materials for meetings of the Council of Ministers, the Standing Committee of the Council of Ministers, the Social Committee of the Council of Ministers, the Economic Committee of the Council of Ministers, the Joint Commission of the Government and Local Self-Government, the Committee for European Affairs, the Committee of the Council of Ministers for Digitalisation within the scope of its competence;
- providing opinions on draft legislation in the area of individual labour law, minimum wages, safe and healthy working conditions and salaries of employees of certain units of the state or local government budgetary sphere;
- reviewing and analysing individual labour law for compliance with EU law, ILO conventions and recommendations and Council of Europe requirements;
- coordinating tasks arising from the participation of Poland in the work of the European Labour Office;
- substantive cooperation with the Labour Law Problem Group of the Social Dialogue Council, the Labour Protection Council at the Sejm and the Chief Labour Inspectorate of the State Labour Inspectorate;
- participating in the work of subsidiary bodies of the EU Council and the European Commission and at other stages of the EU decision-making process in matters related to individual labour law and drafting Polish positions on new proposals for EU legislation on individual labour law;
- analysing questions referred to the CJEU and its jurisprudence in the area of individual labour law and participating in the preparation of draft positions of the Polish side in proceedings before the CJEU in matters concerning the competence of the Department; monitoring the legal status, jurisprudence (including international) and standards, recommendations, guidelines, opinions, etc. from the point of view of compliance of Polish individual labour law with EU law, ILO conventions and recommendations and the requirements of the Council of Europe;
- participation in:
a) decision-making in the EU on individual labour law matters,
b) proceedings before EU authorities and the CJEU on matters concerning the competence of the Department,
c) conducting the Ministry's international bilateral and multilateral cooperation on EU and international individual labour law;
- coordinating tasks arising from the participation of the Republic of Poland in the work of the European Labour Office;
- co-chairing the Labour Subcommittee of the Joint Commission – Implementation of the Agreement between the Government of the Republic of Poland and the Government of the United States of America on Enhanced Defence Cooperation with regard to Article 35 of the Agreement concerning the employment of local civilian workers in Poland;
- implementing NRP reforms and investments within the Department's jurisdiction;
- conducting matters related to the supervision of the Minister over the Central Institute for Labour Protection – National Research Institute (CIOP-PIB);
- cooperation with CIOP-PIB in the programming of scientific research in the field of OHS and ergonomics;
- implementation of tasks relating to the Integrated Qualifications System (IQS), including consideration of applications for inclusion of qualifications in the IQS, granting rights to certify qualifications to specific entities, concluding agreements with external quality assurance entities for certification bodies.
