New ordinance on employment of foreigners

On 29 July this year, the Ordinance of the Minister of Family and Social Policy of 18 July 2022 on the work permits and statements of commission of work to a foreigner replacing the Ordinance of 7 December 2017 on issuing the work permits for the foreigners and entering the statement of commission of work to a foreigner into the statement register entered into force.
The new solution provided for in the Ordinance streamlines the procedure and covers among others:
- adapting the template statements of commission of work to a foreigner to the provisions of the Act extending the period of work under the statement to 24 months,
- streamlining the procedure of obtaining the starost information (so called labour market test) by shortening the procedure on issuing the starost information, where there are no unemployed willing to take a job,
- adapting certain provisions of the Ordinance to the specifics of the ITC systems used in the procedure of obtaining the work permit or statement in order to speed up and streamline the proceedings and encourage to apply electronically.
The new Ordinance, similarly as the existing one, regulates the following issues:
- specifies the types of work permits and mode of proceeding when issuing the work permits and entering the statement of commission of work to a foreigner into the statement register
- specifies the mode of proceeding of the labour office aiming at issuing the starost information on the capacity to satisfy the staff needs of an employer
- provides the list of documents to be accompanied to the applications for issuing the permits or statements and specifies the template documents (among others applications, permits, starost information, certificates of clean criminal record of the employer).
