Pre-retirement benefits

In accordance with Article 3 of Regulation (EC) No 883/04, the scope of benefits covered by EU social security coordination has been extended to pre-retirement benefits.

The term "pre-retirement benefits" includes the following Polish provisions:

  • pre-retirement benefits, regulated by the Act of 30 April 2004 on pre-retirement benefits,
  • bridge pensions and survivors' pensions for persons entitled to the bridge pension, regulated in the Act of 19 December 2008 on bridge pensions,
  • compensatory compensation provided for in the Act of 22 May 2009 on Teacher Compensation Benefits.

Pre-retirement benefits are subject to the coordination of social security systems to a very limited extent. The principle of export of benefits applies to them, however the principle of aggregation of insurance periods does not apply to them in accordance with Article 66 of Regulation No 883/04. The right to pre-retirement benefits is determined solely by the internal legislation in force in the Member State.
