Right to equal remuneration
The Labour Code guarantees the right to equal remuneration for equal work or work of equal value. Remuneration in this sense includes all the components of remuneration, regardless of their name and nature, as well as other work-related benefits, granted to employees in cash or in forms other than cash.
Equal work is work that is the same in terms of type, qualifications needed to perform it and conditions in which it is performed, as well as quantity and quality. Job position may be a comparative criterion in the determination of ‘equal work’, but it is not exclusive. Work that is identical in terms of the type and qualifications required to perform it in the same job positions functioning for a given employer may differ in quantity and quality, in which case it is not identical work.
Work of equal value is work that requires employees to have comparable professional qualifications, confirmed by relevant documents or professional practice and experience, and comparable responsibility and effort.
