Deputy Minister Jadwiga Emilewicz: amendment to the Act on KUKE is an opportunity for Polish and Ukrainian companies to support the reconstruction of Ukraine

The Council of Ministers adopted a draft Act amending the Act on export insurance guaranteed by the State Treasury and certain other acts and repealing the Act on interest subsidies for export credits with fixed interest rates, submitted by the Minister of Development and Technology.

The amendment of the Act on KUKE is fundamental from the point of view of companies operating and exporting their goods and services to Ukraine. The new regulations will be beneficial not only for Polish companies that do or intend to do business in Ukraine, but also for Ukrainian entrepreneurs who want to invest in Poland. Importantly, this would be insurance guaranteed by the State Treasury

- emphasised the Government Plenipotentiary for Polish-Ukrainian Development Cooperation, Deputy Minister of Development Funds and Regional Policy, Jadwiga Emilewicz.

Key solutions contained in the amendment to the Act on KUKE:

With the new legislation, the catalogue of insurance offered by the Export Credit Insurance Corporation (KUKE) will be expanded. More entities will also be eligible for guaranteed insurance.

Private or public entities that enter into contracts or make investments in the country that make a significant contribution to climate change mitigation.  This provides opportunities to support projects that address the energy transition in Poland. 

The provisions being introduced will provide a comprehensive insurance protection for Polish exporters.

The KUKE will be able to expand its offerings to include insurance for the return of an advance payment made by the policyholder on account of import delivery from a country with the so-called non-marketable risk. 

Polish branches of foreign entrepreneurs may will also be insured by the KUKE on an equal footing with Polish companies.  This solution has the potential to increase the security of these entities' overseas transactions and thus influence their development. This will translate into increased job creation opportunities in Poland.

The new regulations are expected to come into force 14 days after their publication in the Journal of Laws.
