Deputy Minister Dariusz Mazur participated in an exchange of views on the joint position of the Venice Commission and the Directorate General of Human Rights and Rule of Law (DGI) of the Council of Europe regarding the draft law amending the Act on the National Council of the Judiciary in Poland. The discussion aimed to approve the urgent opinion issued by the Commission on May 8.
According to the Commission, the proposed reform of the National Council of the Judiciary will protect judicial independence and aligns with European standards, aiming to correct the current method of appointing the Council in accordance with the judgments of the ECHR. Continuing the current situation harms the judiciary's reputation in Poland. The participation of improperly selected National Council of the Judiciary members in decision-making could lead to legal instability and further human rights violations.
The premature termination of the National Council of the Judiciary's term in 2017 was strongly criticized by the Venice Commission and the ECHR. Considering the special circumstances in Poland and legislative actions to restore the rule of law and constitutional order, the Commission deemed that shortening the term of the so-called neo-National Council of the Judiciary is legally justified and consistent with European standards.
At today's session, the urgent opinion of the Venice Commission and the Directorate General of Human Rights and Rule of Law of the Council of Europe from May 8 was approved.
