Denmark ranks the highest in the World Justice Project Rule of Law Index 2023. In contrast, Poland ranks 36th. The European Commission also highly evaluates Denmark in its rule of law reports, highlighting the consistently high level of judicial independence. As Deputy Minister Mazur noted, cooperation between Poland and Denmark will allow Poland to benefit from Denmark's experiences.

The priority for the Polish government is to restore the rule of law and constitutional order. To achieve this, the Ministry and state authorities are undertaking a series of legislative and non-legislative corrective actions.

Deputy Minister Dariusz Mazur, referring to Poland's experiences in recent years, emphasized that returning to the path of the rule of law is still hindered by the lack of agreement from the President of the Republic of Poland to introduce necessary changes in the justice system. He also recalled that in recent years, the politicized National Council of the Judiciary (KRS) has appointed about 3,000 judges, whose status could be challenged due to flaws in the nomination process. The Deputy Minister also discussed solutions aimed at bringing the composition and functioning of the KRS into full compliance with the Constitution, noting that without the President's consent, new laws cannot be implemented.

Minister Marie Bjerre asked the Polish side to present plans related to the upcoming presidency of the EU Council. She also stated that Poland, having concluded the proceedings under Article 7 of the Treaty on European Union, could serve as an inspiration for other countries experiencing a rule of law and democracy crisis.

Both the Polish and Danish sides agreed on the role that civil society can play in protecting the rule of law.

The reforms undertaken by the current government aim, among other things, to incorporate the rulings of European courts into the Polish legal system. The process of restoring the rule of law also includes rebuilding trust between international and European institutions and Poland as an EU member state.
