Meeting of Deputy Minister of Justice Dariusz Mazur with the delegation of deputies and representatives of the Baden-Württemberg government

Deputy Minister of Justice Dariusz Mazur met on June 24, 2024, with the delegation of the Standing Committee of the Landtag, led by Chairman Guido Wolf and the representative of the Baden-Württemberg government, Siegfried Lorek.
The guests, interested in the initiatives undertaken by Donald Tusk's government to restore the rule of law and full democratic values in Poland, expressed their appreciation for the scale and scope of the actions taken by the Minister of Justice, Prosecutor General of the Republic of Poland.
"The courts in Poland are in a difficult situation because over the past eight years, many actions were undertaken under the guise of judicial reform – but in reality, they aimed at institutional dismantling of the judiciary," said Deputy Minister Dariusz Mazur. He added that the previous government aimed to take political control over the judiciary and the prosecution.
Everything began with an attack on the Constitutional Tribunal at the end of 2015. "The Tribunal was transformed from an effective guardian of the Constitution into a tool of the ruling party. This allowed for the adoption of laws not always compliant with the Constitution," he assessed.
He also recalled the politicization of the prosecution, which involved merging the roles of the Minister of Justice and the Prosecutor General. Additionally, the Deputy Minister assessed that the Prosecutor General was granted very broad investigative powers. As a result, this gave him full personal and actual control over the prosecution and the course of investigations.
During the meeting, Deputy Minister Dariusz Mazur presented the ministry's efforts in reforming and repairing the judiciary and restoring constitutional order. "We want to heal the judicial system in Poland as soon as possible. To fully achieve this, new laws are needed," he indicated.
The Minister emphasized that one of the tools for restoring the rule of law in Poland is the developed action plan, known as the Action Plan, which includes a comprehensive reform of the judicial system, particularly reforms of the National Council of the Judiciary and the method of selecting its judicial members, changes in the Constitutional Tribunal, restructuring the organizational structure and scope of powers of the Supreme Court, and changes in the area of disciplinary accountability of judges.
The recent decision by the European Commission to conclude, after nearly seven years, the procedure under Article 7 of the Treaty on European Union against Poland was an expression of appreciation for the determination and scope of the actions taken by the Government to heal the justice system in Poland.
