The European Commission intends to close Article 7 procedure against Poland

The European Commission has informed that it has completed its analysis under the Article 7(1) TEU procedure, which has been conducted against Poland since 2017. This analysis is positive – the EC appreciated the legislative and non-legislative actions taken by Poland to address concerns related to, among others, the independence of judges.

“Today, marks a new chapter for Poland. After more than 6 years, we believe that the Article 7(1) procedure can be closed. I congratulate Prime Minister Donald Tusk and his government on this important breakthrough. It is the result of their hard work and determined reform efforts," said EC President Ursula von der Leyen today (May 6).

In von der Leyen's assessment, restoring the rule of law in Poland is good for Poles and the whole Union. " It is a testament to the resilience of the rule of law and democracy in Europe" she added.

The European Commission launched the Article 7 TEU procedure against Poland in December 2017. In the proposal initiating the proceedings, the EC presented its concerns regarding Poland's respect for the rule of law.

In response, Polish Minister of Justice Adam Bodnar, during a meeting of the General Affairs Council of the European Union, presented Poland's Action Plan for restoring the rule of law. The main points of the reform concerned the National Council of the Judiciary (KRS), the Supreme Court (SN), the Constitutional Tribunal (TK) and the separation of the office of the Minister of Justice and the Prosecutor General.

Since then, the Ministry of Justice has carried out legislative and non-legislative actions, which are implemented in respect of all principles expressed in the Constitution of the Republic of Poland, EU law and the principles arising from the case-law of the Court of Justice of the European Union.
