National Broadcasting Council's support for ukrainian audiovisual regulator

In September and October 2022, the representatives of the KRRiT Office and the National Media Institute organized a series of online workshops for staff and collaborators of the Ukrainian National Television and Radio Council. The meetings were held as part of the realization of the Memorandum of Cooperation signed in July this year between the National Broadcasting Council and the Ukrainian National Television and Radio Broadcasting Council. The workshops met with great involvement and response from the Ukrainian side. It gathered about 100 participants.
It was discussed the structural and organizational issues of the authority's operation, regulatory practice and how monitoring is practiced. Issues related to media investigation were also addressed.
Workshop subjects:
- The organizational structure of the KRRiT, the main tasks of the organizational units of the KRRiT Office, changes related to the new tasks of the Office; the development of reporting, strategic and planning documents;
- Structure and analysis of the audiovisual media services market in Poland and market sectors (broadcasters, operators, VoD and VSP providers;
- Cooperation with the Office of Competition Protection and the Office of Electronic Communications;
- Statutory powers of the National Broadcasting Council and practice of action in the field of media education;
- Processes of licensing and reconcession, revocation and cancellation of licenses, modes of appeal against decisions, model applications, mandatory documents, criteria for evaluating applications, how to resolve proceedings, the content of licenses and their term of validity, fees and discounts;
- Registers and lists, how to identify obligated entities, the mode of imposing sanctions;
- Matters related to relocated broadcasters, operators' enforcement of the ban on distribution of programs;
- Must-carry responsibilities;
- Monitoring practice of broadcasters: in-house functions and outsourcing;
- Revising regulations for the promotion of European works in on-demand audiovisual media services;
- Regulation of activities related to the provision of content on the VSP and bringing them under the jurisdiction of the National Broadcasting Council;
- New rules for advertising activities in media services;
- Modification of regulations regarding obligations to introduce facilities for people with disabilities, including in VoD;
- New rules to protect underage children from dangerous content;
- Self-regulatory practices implemented with the support of the National Broadcasters Council;
- Research practices and activities in the audiovisual sector, types of research (annual, strategic, ad-hoc, etc.), how the need for specific research is shaping up.
Among thanks to the KRRiT, Ukrainian Council Chairwoman Ms. Olha Herasymiuk found it particularly valuable to be able to learn from the KRRiT's knowledge and practice in light of its European experience as a regulator implementing EU regulations, particularly in the implementation of the Audiovisual Media Services Directive.
