The Position of the Chairman of KRRiT on view of the unlawful actions of the Minister of Culture and National Heritage and the “liquidators”

Acting on the basis of Article 10 (1) of the Broadcasting Act and Article 213 (1) of the Constitution of the Republic of Poland, in view of the unlawful actions of the Minister of Culture and National Heritage and the “liquidators” of public broadcasting units and their branches, I hereby declare that the National Broadcasting Council invariably takes the position that there exists a blatant incompatibility with the legality of the resolutions adopted by the Minister of Culture and National Heritage, Mr. Bartlomiej Sienkiewicz, concerning the issue of the dissolution and placing of the public media companies into liquidation, and therefore – the resolutions’ ineffectiveness.
Persons claiming to be “liquidators” do so at their own risk, and any of their actions, orders, motions and requests addressed to employees, managers of public media companies, or third parties under this usurpation should be ignored as coming from unauthorized persons.
At the same time, as Chairman of the National Broadcasting Council, I point out that the actions of unauthorized persons, which I consider these “liquidators” to be, do not have legal effect, including with regard to appointing plenipotentiaries, signing contracts, negotiating salaries, etc. Any motions taken as a result of the actions of unauthorized persons will be legally defective, and the activities of those acting on behalf of or under the authority of the so-called “liquidators” will be subject to appropriate scrutiny.
