INVITATION TO TENDER FOR THE SALE OF A VEHICLE

The Embassy of the Republic of Poland in Kuala Lumpur (hereinafter referred to as the "Seller" or "Tender Organizer") announces a public tender for the sale of a passenger car – BMW 730LI
1. The Seller:

2. Place and date of opening the bids:
2.1. The bids will be opened at the tender committee meeting at the seat of the Seller, referred to in point 1 above, on 14.02.2024 at 10.00 a.m. local time (Malaysia).
2.2. The opening of bids is public.
2.3. During the opening of bids, the name of the tenderer whose bid is being opened is given, as well as information on the price. Bids are opened in the order in which they were received at the seat of the Tender Organizer.
3. Type and quantity of movable assets sold:

4. Place and date at which the vehicle may be viewed:
The vehicle being the subject of the tender can be viewed at the Seller's premises, i.e. at:

- on working days from Monday to Friday from 30.01.2024 to 13.02.2024 between 09:00 am – 05:00 p.m. local time, after prior arrangement by phone or e-mail with Mrs. Urszula Bilska,

5. Amount of the bid bond and the form and date of its submission:
5.1. The condition for participation in the tender is the payment of a bid bond. The tender guarantee is 10% of the starting price of the vehicle sold, i.e. RM 3157,50 (say: three thousand one hundred and fifty-seven and 50/100 Malaysian ringgits only).
5.2. The bid bond should be paid in cash at the cash desk of the Embassy of the Republic of Poland in Kuala Lumpur or by bank transfer (before the deadline for submission of tenders) to the following bank account: 7144 2200 1559 MFCA, Account owner: Embassy of the Republic of Poland in Kuala Lumpur, SWIFT: MBBEMYKL, ID number: KL721512013 The payer of the transfer must bear all bank fees related to this transfer and indicate: "BMW WADIUM" in the title of the transfer
The confirmation of the payment of the bid bond (a copy of the receipt from the Embassy or a stamped and signed bank confirmation of the bid bond transfer) must be attached to the offer.
5.3. The bid bond submitted by bidders whose bids have not been selected or have been rejected, the Seller shall return within 7 days, from the date of selection or rejection of the offer, respectively.
5.4. The bid bond made by the buyer is included in the price.
5.6. The bid bond is not refundable in the event that the winning bidder refrains from concluding the sale agreement.
6. The starting price:
The starting price is RM 31 575,00 (say: thirty-one thousand five hundred seventy-five and 00/100 Malaysian ringgits only).
7. Requirements to be met by the offer:
7.1. The Bidder submits the bid on the form constituting Appendix 1 to the Invitation.
7.2. The written bid submitted in the tender should contain:
1) name, surname and place of residence or company and seat of the tenderer, contact telephone number, e-mail;
2) a specific asset for which the offer is submitted, the offered price for the movable property subject to the tender (not lower than the starting price);
3) declaration of the tenderer that he has become acquainted with the condition of the subject of the tender or that he is responsible for the consequences of resignation from becoming acquainted with the condition of the subject of the tender;
4) in the event of joining the tender of a legal person, a valid copy of the tender must be attached to the tender from the correct registry;
5) a statement on reading the information regarding the processing of personal data.
7.3. Each bidder may submit only one bid.
7.4. The offered price may not be lower than the starting price.
8. The date, place and procedure for submitting the offer and the period during which the bid is binding:
8.1. The bid along with the required documents should be submitted in a sealed envelope.
8.2. The envelope must be addressed according to the following pattern:

8.3. The envelope should bear the inscription:
“Offer to buy a BMW 710LI”.
8.4. Written bids should be submitted on working days (from Monday to Friday) from 09:00 – 17:00,
no later than 14.02.2024 to 09:30 am local time at the Seller's premises.
8.5. The submitted bid is immediately confirmed by the bid security paid in cash at checkout of the Embassy of the Republic of Poland in Kuala Lumpur in the amount of 10% of the starting price, i.e.
RM 3157,50 (say: three thousand one hundred fifty-seven and 50/100 Malaysian ringgits only).
8.6. The period of validity of the offer is 30 days from the date of opening the offers.
9. Rejection of bids:
9.1. The tender committee rejects the bid if:
9.1.1. It was submitted after the prescribed deadline, in the wrong place or by the tenderer who did not provide the bid bond;
9.1.2. It does not contain the data and documents referred to in point 7 above, or they are incomplete, illegible or raise other doubts, and its supplementation or submission of explanations could lead to its being considered a new offer;
9.2. The tender committee shall immediately notify the tenderer of the rejection of the bid.
10. Other information:
10.1. The tender committee will select the tenderer offering the highest price for the vehicle being the subject to the tender. The sale cannot be made for a price lower than the starting price.
10.2. Tenderers will be informed about the result of the procedure within 7 days from the date of opening the tenders by posting information about the result of the procedure on the website of the Tender Organizer.
10.3. The tenderer who offers the highest price will be informed immediately and invited to sign a contract for the sale of the vehicle. The amount of the bid bond paid by him/her will be included in the purchase price.
10.4. The bid bond submitted by the tenderers whose bids are not selected or rejected, will be returned within 7 days immediately after selecting the bid or its rejection.
10.5. The bid bond is forfeited to the Seller if the tenderer whose bid is accepted fails to pay.
10.6. If it is established that several bidders offered the same price, the Seller decides to continue the tender in the form of an auction between these bidders, setting the auction date and rules, including the amount of the bidding.
10.7. Bid selection criteria - the highest price.
10.8. If the tenderer whose bid is selected does not pay the amount offered to the Seller's bank account within 7 working days from the date of signing the sales contract, he loses the right to purchase the car that is the subject of the tender, and the Seller reserves the right to choose the next best offer.
10.9. The Seller does not issue an invoice for the purchased vehicle. The basis for payment and delivery of the subject of sale will be the sales contract, which will be concluded within 14 working days from the date of the tender.
10.10. The ownership of the car will be transferred to the buyer immediately after the buyer pays the purchase price, within the time limit specified by the Seller, on the basis of the signed sales contract and confirmation that the amount paid by the buyer has been credited to the Seller's bank account.
10.11. The car will be collected at the following address: No. 10, Lorong Damai 9, 55000 Kuala Lumpur, Malaysia.
10.12. The Seller does not guarantee the condition of the vehicle covered by the tender and is not responsible for hidden defects of the vehicle. Once the subject of the tender is handed over to the buyer, all benefits and burdens related to the purchased vehicle are transferred.
10.13. All costs, taxes and fees related to the purchase of the vehicle are borne by the Buyer. By entering the tender, the Buyer agrees and undertakes to pay all taxes and fees required by the authorities of Malaysia, Poland and / or other country to which the vehicle will be shipped after sale.
10.14. The Seller has the right to close this tender without selecting any bids, without giving reasons.
