Extending the validity of temporary protection certificates
25.04.2023
The temporary protection mechanism, implemented by the EU Council's decision in March 2022 initially for one year, was extended until March 4, 2024. As a result, the validity of the certificates of temporary protection issued so far, will also be extended alike.
Those who have received from the Office for Foreigners a certificate of temporary protection with an expiry date of March 4 or September 4, 2023 do not need to apply for new documents. Certificates issued will remain valid until March 4, 2024.
The legislation does not provide a legal basis for replacing certificates already issued following the extension of temporary protection. The documents contain an appropriate annotation that can be extended by operation of law. Hence, foreigners who have so far received certificates can continue to use them as residence permits confirming their legal status.
Foreigners who are not covered by the law on assistance to Ukrainian citizens in connection with the armed conflict on the territory of the country, but who belong to the category of displaced persons mentioned in the EU Council’s implementing decision stating the existence of a mass influx of displaced persons from Ukraine, may benefit from temporary protection on the territory of the Republic of Poland. In this case, being covered by temporary protection is confirmed by the certificate issued by the Office for Foreigners.
