CERTIFICATES
Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000 provided for four standard forms:
- Certificate referred to in Article 39 concerning judgments in matrimonial matters
- Certificate referred to in Article 39 concerning judgments on parental responsibility
- Certificate referred to in Article 41(1) concerning judgments on right of access
- Certificate referred to in Article 42(1) concerning the return of a child
IMPORTANT! The certificates referred to in Article 39 of Council Regulation (EC) No 2201/2003 may be issued only by the competent court or authority of the Member State of origin (i.e. where the judgment was given), at the request of an interested party, while the certificates referred to in Articles 41(1) and 42(1) of that Regulation may be issued only by the court of origin! They may not be filled in by the interested party!
