Duration of parental leave

Employees-parents of a child are entitled to parental leave to take care of a child, up to:

  1. 41 weeks – in the case of birth of one child;
  2. 43 weeks – in the case of multiple birth.

Employees-parents of a child holding the certificate referred to in Article 4(3) of the Act of 4 November 2016 on support for pregnant women and families ‘For Life’ shall be entitled to parental leave to take care of that child, up to:

  1. 65 weeks – in the case of birth of one child;
  2. 67 weeks – in the case of multiple birth.

Parental leave in the above amount is granted to both employees-parents of the child, together.

Parental leave shared by parents

Both employees-parents of a child can take parental leave at the same time. In such a case, the total duration of parental leave may not exceed the overall eligible amount.

During the period when one of the child’s parents is receiving maternity allowance for the period corresponding to the period of parental leave, the other parent may take parental leave. In such a case, the combined length of parental leave and the period of maternity allowance for the period corresponding to the parental leave may not exceed the overall eligible amount.

Non-transferable part of leave

Each employee-parent of a child shall have the exclusive right to 9 weeks of parental leave from the aforementioned leave. This right may not be transferred to the other employee-parent of that child.

Taking at least 9 weeks of parental leave means that the employee-parent of a child has taken the non-transferable portion of that leave.

Parental leave resignation

An employee may decide not to use parental leave at any time and, with the employer’s consent, return to work.
