In the event of childbirth, employees are entitled to leave associated with childcare.

The rights associated with childcare may be exercised by the parents if they are employees.

Leave associated with childcare includes:

1. maternity leave or leave granted on terms of a maternity leave (in case of an adoption), in the amount of:

a. 20 weeks – in the case of birth of one child or in the case of adoption of one child,

b. 31 to 37 weeks – in the case of multiple births or in the case of simultaneous adoption of more than one child;

2. parental leave granted no later than by the end of the calendar year in which the child reaches the age of 6 years, in the amount of:

a. 41 or 43 weeks, depending on the number of children born or adopted simultaneously;

b. 65 or 67 weeks, in case of employees-parents of a child/children holding the certificate referred to in Article 4(3) of the Act of 4 November 2016 on support for pregnant women and families ‘For Life’;

3. paternity leave of up to 2 weeks (granted no later than until the child reaches 12 months of age or until 12 months after the date on which the decision of the adoption of the child becomes final and valid, and no later than until the child reaches the age of 14 years;

4. childcare leave of up to 36 months, granted for a period no longer than until the end of the calendar year in which the child reaches the age of 6 years; 'additional' childcare leave of up to 36 months may be granted for a child with a disability and it may be used no longer than until the child reaches the age of 18 years.
