Employee's request

An employee employed by an employer for at least 6 months may request the employer once a calendar year to change the type of employment contract into a contract of employment for an indefinite term or apply for more predictable and secure employment conditions. These conditions may include, for example, a change in the type of work or a change to full-time employment.

The request may be submitted in paper or electronic form. The employer should, where possible, grant the employee’s request.

The employer shall provide the employee with a response to the request, taking into account the needs of the employer and the employee, no later than 1 month from the date of receipt of the request. If the request is not granted, the employer informs the employee of the reason for the refusal. The response may be in paper or electronic form.

An employee’s period of employment with the previous employer shall be counted as part of the employee’s period of employment if the change of employer has taken place through the transfer of the undertaking or part of it to another employer. The period of employment with the previous employer shall also be counted in other cases where, by virtue of separate legislation, the new employer is the legal successor of the employer who previously hired the employee.
