Inheritance proceedings
According to the Act of 25 June 2015 Consular Law (Journal of Laws of 2018, item 2141, as amended) currently in force, the consul can secure and execute Polish State Treasury's property rights in relation to inheritance and donations. Therefore, currently consuls can only handle inheritance cases on behalf of Polish State Treasury. The consul has no legal capacity to undertake the power of attorney, representation or any other actions within an inheritance case on behalf of a Polish citizen. Neither does the Minister of Foreign Affairs.
It is possible, however, for the consul to authenticate your declaration of acceptance or rejection of inheritance which you should file with a court as an heir.
