Draft amendments to the laws governing nuclear facilities adopted by the Government

The Council of Ministers has adopted a draft act amending the act on the preparation and implementation of investments in nuclear power facilities and associated investments, submitted by the Minister of Climate and Environment.
According to the adopted schedule, the construction of the first nuclear power plant in Poland will start in 2026 with the first reactor, with a capacity of 1-1.6 GWe, being commissioned in 2033. Subsequent units will be built every 2 to 3 years, and the whole nuclear power programme speaks about 6 units with total installed power of ca. 6 to 9 GW, with large, well-tested pressurised water reactors PWR Generation III (+).
The main purpose of the amendments is to accelerate the construction.
Key solutions
- The catalogue of accompanying investments will also be expanded to include investments necessary to conduct environmental and site research for the construction of a nuclear power plant and associated infrastructure.
- Better stability of the investment process will be ensured by placing the fundamental decision at the initial stage of the process – before the siting decision.
- The siting decision and the permit to access the property will also be extended for measurements, tests or other work necessary for the preparation of the environmental impact report of the project.
- The seller or buyer of the real property covered by the siting decision will have to notify the data of a new owner to the relevant provincial governor (voivode). The lack of notification and conducting proceedings without the participation of a new owner will not be a basis for resuming the proceedings or their annulment.
- Public administration authorities, upon the investor’s reasoned request, will provide information and data to be used in connection with the tasks related to nuclear facilities and associated investments at no charge.
- There will be an option of temporary operation of a nuclear facility after obtaining a commissioning licence. Until the operating licence is issued, however no longer than the time defined in the commissioning licence, the nuclear facility will be operated under the licence and the nuclear facility commissioning report approved by the PAA President.
New laws should come into force by the end of the year.
