Information clause for journalists in relation to personal data processing by the Ministry of Climate and Environment for the purpose of disclosure of public information or media coverage

Pursuant to Article 13(1) and (2) and Article 14(1) and (2) of Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ  L 119 of 04.05.2016, p. 1, as amended), hereinafter referred to as: GDPR, I kindly inform as follows:

Only matters related to the processing of your data by the controller, including the exercise of your rights under the GDPR should be referred to the DPO.

Source of data origin

Whenever your data has not been made available directly by you, it has been acquired directly from you or from the press agency/media group you cooperate with or from publicly available sources, such as, but not limited to, the websites of press offices, press, social media.

Categories of personal data processed:

- first name and surname,

- e-mail address,

- telephone number,

- name and/or address and/or other contact details (telephone number, e-mail address) of the editorial office/publishing house a journalist cooperates with.

Purposes of personal data processing and legal basis

Your personal data will be processed:

  • for the purpose of responding to press enquiries and media coverage1
  • for the purpose of fulfilment of the obligation to archive documents2

Data recipients or categories of data recipients

Your personal data is shared with an entity processing personal data on behalf of the Controller under the agreement concluded for the entrustment of the processing of personal data (the so-called processor), i.e. a company providing IT services.

Your personal data may be made available to bodies authorised under the provisions of commonly applicable law, but they do not constitute recipients of data within the meaning of the provisions of the GDPR.

Period of personal data retention

Your personal data will be stored for the period necessary for the purpose of processing, i.e. disclosure of public information or media coverage, requests for public information, requests for providing public sector information for re-use, replies to inquiries, decisions refusing the provision public information will be subsequently stored for a period of 10 years on the basis of the Office Instructions in force at the Ministry of Climate and Environment (archival category B10) and the provisions of the Act of 14 July 1983 on the National Archive Repository and Archives.

Rights granted in relation to personal data processing

You shall have the following rights:

  • the right to access the data and to obtain a copy thereof
  • the right to rectification of the data
  • the right to restrict the processing

  • the right to lodge a complaint with the President of the Office for Personal Data Protection (ul. Stawki 2, 00-193 Warszawa) if you recognise that we are processing your data unlawfully.

Information on personal data transfer to third countries

We do not transfer your data to third countries.

Information on automated decision-making

Your personal data is not subject to automated decision-making, including profiling.

Information on the discretion or obligation to provide personal data

The provision of your data is voluntary, however, failure to provide the data to the extent required by the controller will result in the inability to handle your case, as well as to verify your status as a journalist by the Minister of Climate and Environment.
