Information clause concerning personal data processing at the Ministry of the Interior and Administration
The Controller of your personal data is the Minister of the Interior and Administration (MSWiA), ul. Batorego 5, 02-591 Warsaw. If you refer to another personal data controller entity (body) serviced by the Ministry of the Interior and Administration, the controller of your personal data is that entity. In particular, the controller is also the Internal Oversight Inspector (BNW).

The controller (Ministry of the Interior and Administration and BNW) appointed a Data Protection Officer whom you can contact via e-mail: iod@mswia.gov.pl (MSWiA) and iod.bnw@mswia.gov.pl (BNW). You can contact your Data Protection Officer in all matters concerning the processing of personal data and the exercise of rights relating to personal data processing.
Your personal data will be processed if it is necessary to:
- fulfil the legal obligation incumbent on the controller and in particular to process the case in accordance with the applicable law;
- protect the vital interests of the data subject or another natural person;
- perform a task carried out in the public interest or in the exercise of public authority vested in the controller, as well as in other cases specified in the existing legislation regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (repealing Directive 95/46/EC; hereinafter referred to as the GDPR). The detailed basis for processing your personal data depends on the nature of your reference.
Your personal data will be:
- made available to entities with appropriate legal authorisation and in accordance with the legal regulations in force;
- stored for the duration of the case and then kept for the period and to the extent required by applicable law. In the absence of such law, in the case of personal data processing based on your consent (including the voluntary transfer of data by you), your personal data will be processed until such time as you withdraw your consent to personal data processing.
In the cases, under the rules and procedures set out in the applicable regulations, you have the right to
- access and rectify your data;
- delete the data (see Article 17 of the GDPR);
- restrict processing (see Article 18 of the GDPR);
- data portability – including if your data is processed on the basis of consent (see Article 20 of the GDPR);
- withdraw your consent (if your data is processed on the basis of consent) at any time;
- object to the processing of your personal data (see Article 21 of the GDPR).
You also have the right to lodge a complaint with a supervisory authority, that is the Head of the Personal Data Protection Office.

Subject to specific legal provisions, the provision of data is voluntary but necessary for the consideration/processing of your complaint, in particular in accordance with the relevant provisions.
Information clause concerning the processing of personal data by the Office for Internal Oversight (BNW) at the Ministry of the Interior and Administration for the purposes of preventing and combating crime
Due to the implementation of the Act of 14 December 2018 on the protection of personal data processed in connection with preventing and combating criminal activity (hereinafter the “DODO”), in adherence with the provisions contained therein, we inform you that:
The controller of your personal data is the Internal Oversight Inspector.

Your personal data will be processed for the purposes of preventing and combating crime in connection with the implementation of the tasks set out in the Act of 21 June 1996 on special forms of oversight by the minister competent for internal affairs.
In connection with the processing of personal data in accordance with the DODO, you are entitled to lodge a complaint with the supervisory authority, that is the President of the Personal Data Protection Office (or any other person exercising oversight under separate regulations) if you consider that your rights have been infringed by the processing of your personal data. In addition, you have the right to demand access your personal data from the controller, to rectify or delete your personal data, or to restrict the processing of your personal data, in situations provided for by law.
Video monitoring – information on personal data processing
The controller of personal data in the form of an image recorded with the use of technical means enabling image recording (video monitoring) is the Minister of the Interior and Administration, ul. S. Batorego 5, 02-591 Warsaw.

The Ministry of the Interior and Administration designated a Data Protection Officer to contact on matters related to personal data protection – email address: iod@mswia.gov.pl.
The processing by the Ministry of the Interior and Administration of personal data recorded on video is necessary to ensure the safety of persons and protection of property. The legal basis for the processing of personal data is Article 6(1)(c) GDPR in connection with Article 5a of the Act of 16 December 2016 on the principles of state property management (Journal of Laws of 2018, item 1182), Article 22² of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2018, item 917 as amended).
Monitoring covers the external and internal premises.
There will be no automated decision making or profiling during the processing of data.
The data may be transferred to entities processing personal data at the request of the Data Controller, as well as to other entities authorised under the law.
The data will not be transferred to a third country or to an international organisation.
Image recordings will be processed only for the purpose for which they were collected and will be kept for a period not exceeding 3 months from the date of recording. A recording of the
image constituting evidence in a case related to ensuring physical security and protection of legally protected secrets in the Ministry may be stored until the case is resolved and then destroyed.
You have the right to access your personal data and the right to rectify or delete the data if it is processed illegally.
As the processing of personal data is based on Article 6(1)(c) of the GDPR, you have no right to data portability and no right to object.
You are also entitled to lodge a complaint with a supervisory authority, that is the Head of the Personal Data Protection Office.
